General provisions

For the purposes of exercising its activity, Ambulatoria za individualna praktika za spetsializirana izvanbolnichna pomost "Fetalna meditsina" Ltd (hereinafter referred as AIPSIP "Fetalna meditsina") processes personal data of natural persons (hereinafter referred as "Data subjects") in accordance with the Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred as  "Regulation (EU) 2016/679”), the Personal Data Protection Act, legal acts in the healthcare sector and this Data Protection Policy.

The purpose of this Data Protection Policy is to inform the data subjects about what personal data are processed by AIPSIP "Fetalna meditsina", for what purpose and for how long the personal data will be processed and what their rights are.

Definitions

Personal data” means any information relating to a natural person who can be identified, directly or indirectly, in particular by reference to an identifier;

Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means.

"Data concerning health" means personal data related to the physical or mental health of a natural person, including the provision of health care services, which reveal information about his or her health status. These data are subject to special protection, given their sensitive nature, and are processed by health professional subject to the obligation of professional secrecy.

Natural persons whose personal data are processed

AIPSIP "Fetalna meditsina" processes personal data about the following natural persons:

  • Patients and their relatives, if required;
  • Staff - Current and former employees of AIPSIP "Fetalna meditsina", job applicants, as well as trainees;
  • Visitors;
  • Business partners or potential business partners of AIPSIP "Fetalna meditsina" and their employees.

Purposes of personal data processing

AIPSIP "Fetalna meditsina" processes personal data for the following purposes:

  • Provision of health services - medical diagnostics, medical treatment, clinical studies, etc.;
  • Fulfillment of legal obligations by AIPSIP "Fetalna meditsina", in particular under the Health Act, the Health Insurance Act, the Medical Establishments Act, the implementing regulations, the National Framework Agreement;
  • Compliance with the requirements of the labor and social legislation regarding the employees;
  • Other legitimate purposes, such as bookkeeping, maintenance and security of the AIMCPI "Fetal Medicine" website: www.pregnancy.bg (hereinafter referred as the "website") and the AIPSIP "Fetalna meditsina" IT systems, protection of the legitimate interests of AIPSIP "Fetalna meditsina", including in court, etc.

Legal grounds for processing personal data

AIPSIP "Fetalna meditsina" processes special categories of personal data, such as data concerning health, genetic data, or data concerning a natural person's sex life or sexual orientation, only under one of the following conditions according to the Regulation (EC) 2016/679:

  • Data subject has given consent to the processing of his or her personal data for one or more specific purposes, unless the legislation excludes the possibility of such consent. The data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
  • Processing is necessary to protect the vital interests of the data subject or of another natural person where the data subject is physically or legally incapable of giving consent;
  • Processing is necessary for the purposes of preventive or occupational medicine, for the assessment of the working capacity of the employee, medical diagnosis, the provision of health or social care or treatment;
  • Processing is necessary for reasons of public interest in the area of public health, such as protecting against serious cross-border threats to health or ensuring high standards of quality and safety of health care and of medicinal products or medical devices.

AIPSIP "Fetalna meditsina" also processes other personal data under one of the following legal conditions according to the Regulation (EC) 2016/679:

  • Data subject has given consent to the processing of his or her personal data for one or more specific purposes, unless the legislation excludes the possibility of such consent. The data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
  • Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
  • Processing is necessary for compliance with a legal obligation to which the controller is subject;
  • Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

Personal data processing by visiting the website

By visiting the website, it is possible to automatically collect technical information such as internet protocol or IP address, login information, browser type, time zone, operating system, etc., device (personal computer, mobile phone or tablet) and other technical information, as well as information about the visit, the time spent on the website, viewed pages. These data are collected for security purposes and for optimizing and improving the website. AIPSIP "Fetalna meditsina" has a legitimate interest in protecting the website and improving its services.

Personal data processing by using an online contact form

By using the online contact form available on the website, the data subject should enter a name, contact phone number and/or email address and the relevant inquiry. The personal data entered are processed only for the purpose of responding to the inquiry.

Personal data processing by using services

By using the online function for making an appointment with an obstetrician-gynecologist available on the website, the data subject should enter the following data: first name, surname, date of birth (optional), phone number and email address. The entered personal data are processed only for the purposes of handling the request for an appointment.

By making an appointment with an obstetrician-gynecologist by phone, the data subject should provide the following data: first name, surname, date of birth (optional), phone number and email address. The provided personal data are processed only for the purposes of handling the request for an appointment.

By providing medical services AIPSIP "Fetalna meditsina" processes data concerning health, including genetic and/or biological material, required for the provision of health services requested by the data subject, including making a medical diagnosis.

Recipients of personal data

AIPSIP "Fetalna meditsina" provides personal data to:

  • Competent public authorities implementing legal provisions, including the National Health Insurance Fund, the Ministry of Health, NRA, NSSI etc.;
  • External laboratories or other medical establishments;
  • Commercial companies providing services to AIPSIP "Fetalna meditsina", including maintenance and security of IT systems.

The right to collect, process, use and store health information shall be exercised in accordance with Article 27 of the Health Act. Health information shall be provided to third parties when:

  • the medical treatment of the person will be continued by another medical institution;
  • there is a threat to the health or life of others;
  • it is necessary to identify a human body or to establish the causes of death;
  • it is necessary for the needs of State Health Control to prevent epidemics and spread of infectious diseases;
  • It is necessary for the needs of medical expertise and social security;
  • It is necessary for the needs of medical statistics or for medical research, once data identifying the patient have been deleted;
  • It is necessary for the needs of the Ministry of Health, the National Center for Health Information, the National Health Insurance Fund, the Regional Health Inspections and the National Statistical Institute.
  • It is necessary for the needs of an insurer licensed according to the Section I of Annex 1 or (2) or to (1) and (2) of Section II, (A) of Annex 1 to the Insurance Code.

In the above-mentioned cases AIPSIP "Fetalna meditsina" takes the necessary measures to protect the rights and interests of data subjects, such as assuming explicit contractual obligations by the processors of personal data to ensure the data security and protection of their confidentiality.

Term of personal data storage

The data subject's personal data are stored in accordance with the statutory time limits for the relevant medical records.

The personal data of job applicants who are not approved for an employment in AIPSIP "Fetalna meditsina" shall be stored for the period determined in accordance with the applicable legislation concerning personal data protection, until the procedure is completed. After that, the personal data shall be returned to the data subject or destroyed. Personal data may be stored for a longer period with the consent of the applicant in writing.

The personal data contained in the accounting documents shall be stored within the time limits for the storage of the accounting information provided in the Accountancy Act.

Personal data security

 Taking into account the nature, scope, context and purposes of processing as well as the risks of varying likelihood and severity for the rights and freedoms of natural persons, AIPSIP "Fetalna meditsina" implement appropriate technical and organisational measures to ensure that the processing of personal data is carried out in accordance with Regulation (EC) 2016/679.

  • object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims;
  • to withdraw his or her consent under Article 6 (1) (a) of Regulation (EU) 2016/679 to the processing of his or her personal data for one or more specific purposes or his or her consent under Article 9 (2) (a) to the processing of special categories of personal data for one or more specified purposes at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

AIPSIP "Fetalna meditsina" reserves the right to make changes to this Data Protection Policy by publishing these changes on its website in a timely manner. Changes are applied from the date of their publication on the website noted in the document.
